Further, the information found in this Site is not intended to create, and does not create, any legal relationship between you and anyone else. Communicating through the telephone, email or a form on this Site will not create a representative or attorney-client relationship with anyone. The only way to receive representation is through a formal written agreement signed by both you and the provider of the services. Our Site is a general audience Site with content directed at individuals over the age of 18 and is not directed at children under the age of 18. In accessing or using this Site, you affirm that you are over 18. By submitting your information on this Site, you are consenting to the gathering of Personal Information about you, in accordance with the Benefits Justice Privacy Policy, and agree that this information may then be transmitted to individuals, law firms, or advocacy groups who are qualified to represent, or to find representation for, you. All testimonials used come from actual clients of our associated law firms or advocates, though names may be altered to protect identities.

Liability Limitations. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BENEFITS JUSTICE BE LIABLE FOR ANY INJURIES, LOSSES, CLAIMS, OR DIRECT DAMAGES OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHICH ARISE OUT OF OR ARE ANY WAY CONNECTED WITH (1) THE SITE (2) ANY USE OF THE SERVICES ON THE SITE OR THE BENEFITS JUSTICE CONTENT, (3) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO, THE USE OR INABILITY TO ENGAGE ANY LEGAL SERVICE PROVIDER), OR (4) YOUR ENGAGEMENT OF ANY LEGAL SERVICE PROVIDER OR THE PERFORMANCE, NON-PERFORMANCE, CONDUCT, OR POLICIES OF ANY LEGAL SERVICE PROVIDER. IN ADDITION, YOU SPECIFICALLY UNDERSTAND AND AGREE THAT ANY THIRD PARTY DIRECTING YOU TO THE BENEFITS JUSTICE SITE BY REFERRAL, LINK, OR ANY OTHER MEANS IS NOT LIABLE TO YOU FOR ANY REASON WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DAMAGES OR LOSS ASSOCIATED WITH THE USE OF THE SERVICES OR THE BENEFITS JUSTICE CONTENT. BENEFITS JUSTICE IS NEITHER AN AGENT OF NOR OTHERWISE ASSOCIATED WITH ANY LEGAL SERVICE PROVIDER.

Disclaimer of Warranties. THE SITE, ALL BENEFITS JUSTICE CONTENT, AND ANY OTHER INFORMATION, PRODUCTS, AND MATERIALS CONTAINED IN OR ACCESSED THROUGH THE SITE, ARE PROVIDED TO YOU ON AN “AS IS” BASIS AND WITHOUT WARRANTY OF ANY KIND. BENEFITS JUSTICE EXPRESSLY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES, CONDITIONS, OR INDEMNITIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, OR ANY WARRANTY ARISING FROM A COURSE OF DEALING, PERFORMANCE, OR TRADE USAGE. BENEFITS JUSTICE DOES NOT WARRANT THAT YOUR USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT BENEFITS JUSTICE WILL REVIEW THE INFORMATION OR MATERIALS MADE AVAILABLE THROUGH THE SITE FOR ACCURACY OR THAT IT WILL PRESERVE OR MAINTAIN ANY SUCH INFORMATION OR MATERIALS WITHOUT LOSS. BENEFITS JUSTICE SHALL NOT BE LIABLE FOR DELAYS, INTERRUPTIONS, SERVICE FAILURES, OR OTHER PROBLEMS INHERENT IN USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS OR OTHER SYSTEMS OUTSIDE THE REASONABLE CONTROL OF BENEFITS JUSTICE.

Benefits Justice assumes no liability whatsoever for any such third-party Sites or any content, features, products, or services made available through such third-party Sites.

Release. The legal service providers with which you communicate are solely responsible for their interactions with you and any and all claims, injuries, illnesses, damages, liabilities, and costs (“Claims”) suffered by you as a result of your interaction with any legal service provider or from any product or service of any legal service provider. You hereby release Benefits Justice and its officers, directors, members and managers from any and all such Claims. IN CONNECTION WITH THE FOREGOING, IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” You hereby expressly waive and relinquish all rights and benefits under that section and any law of any jurisdiction of similar effect with respect to the release of any unknown or unsuspected claims you may have against the Benefits Justice Parties pertaining to the subject matter hereof.

If you have any dispute concerning any aspect of these Terms of Website Use, the Website, or any of our services, you agree to submit your dispute for resolution by arbitration before the American Arbitration Association ("AAA") in the county where you live by filing a Demand for Arbitration. The arbitrator will have exclusive authority to resolve any dispute including any claim that all or any part of these Terms of Website Use are unenforceable.

Opt-Out of Arbitration/Class Action Waiver. The Terms & Conditions do not constitute a waiver of any of your rights and remedies to pursue a claim individually and not as a class action in binding arbitration as provided above. This provision preventing you from bringing, joining or participating in class action lawsuits is an independent agreement. You may opt-out of these Dispute Resolution Provisions by providing written notice of your decision within thirty (30) days of the date that you first register on the Benefits Justice Website.

YOU ACKNOWLEDGE AND AGREE THAT, VIA YOUR ACCEPTANCE OF THESE DISPUTE RESOLUTION PROVISIONS, YOU WAIVE ANY RIGHT TO A JURY TRIAL, AS WELL AS YOUR RIGHT TO BRING, JOIN OR PARTICIPATE AS A PLAINTIFF OR A CLASS MEMBER IN A CLASS ACTION SUIT OR MULTI-PARTY ARBITRATION BROUGHT AGAINST US, ANY PERSON RELATED TO US OR A SERVICE PROVIDER USED BY US TO PROVIDE THE SERVICE.

You and Benefits Justice understand and agree that the disclaimers, exclusions, and limitations herein are essential elements of this Agreement and that they represent a reasonable allocation of risk. In particular, you understand that Benefits Justice would be unable to make the Site and the services provided through the Site available to you except on these terms and you agree that this Agreement will survive and apply even if any limited remedy specified in this Agreement is found to have failed of its essential purpose.
